1.1 Services: Welcome to the LaundryOut.com website “Website”. Our Website is only for use by individuals over the age of 18. We provide pick up and delivery laundry cleaning services via our website. (“Services”).

1.7 Submitted Item: Any post, photograph, image, GIF, video, “favorites” list, comments, feedback, postcards, suggestions, notes, and other information, content or material, or other item that you or your agents disclose, email, fax, offer, text, or post to the Website, or disclose to us through Services provided to you.

Cleaning services are not without some risk to garments. Some risks of using any cleaning service includes: damage or destruction of clothing items; staining or alterations of color; running, ripping, tearing, or unwinding of fabric and stitching; shrinkage; stretching, and more. Our cleaning services are not appropriate for all clothing materials, garments designs, or methods of clothing production. By using our Services, you represent and warrant that you have consulted the clothing’s manufacturer’s recommendations, and that you have determined that you have selected only the Services that you know to be appropriate for your clothing. You also hereby represent and warrant that you have placed, and will place, only clothing items in our laundry bags, and that all clothing pockets have been emptied of any items. You expressly waive any and all claims, actions for damages or costs, or other causes against us that arise from any damage to your clothing from our Services. Additionally, not all items may be restored to like-new condition, and some stains are permanent. You hereby understand and agree that items may be sufficiently cleaned despite continued appearance of stains.
2.22 Not all cleaners and detergents are right for all people. Some people have allergies and sensitives to detergents and other chemicals used in the cleaning process. As a result, some people may experience skin problems, including: rash, itching, hives, sensitivity, and other medical issues. If any such reactions occur, immediately discontinue wearing or coming into contact with the cleaned clothing and consult a medical professional. By using our Services, you represent and warrant that you understand the risks and that you have disclosed to us all relevant medical conditions, and that you have not used our Services without consulting with a licensed medical professional regarding any of your medical risks.
2.23 We reserve the right to refuse to clean any item submitted for any reason.
Section III – Dispute Resolution
3.1 In the event of disputes resulting from the use of our Services, the parties will first consult together with a view to resolve the dispute amicably.
3.2 If the parties are unable to resolve a dispute amicably, it will be referred to the Superior court in King County, Washington.
3.3 Your use of our Services and any dispute arising out of such use of the Website is subject to the laws of King County, Washington, United States of America and applicable federal law without regard to conflicts of laws principles.

Section V – Governing Law, Disclaimer, and Limitation of Liability
5.1 This Agreement shall be construed and enforced in accordance with the laws of the State of Washington, without effect to the State’s choice or conflicts of law provisions. In the event any dispute arises out of or relating to this Agreement results in litigation, the Parties agree that the same shall be heard in a state or federal court having subject matter jurisdiction seated in King County, Washington, and the Parties submit to personal jurisdiction of such court and agree that venue shall properly lie therein.
5.2 LIMITED LIABILITY. We shall not be liable for any failure of the Services, or any delay in the availability thereof. We shall not be liable for any loss, damage, liability, cost or expense incurred by You arising from any interruption in internet access, no matter the cause. WE MAKES NO REPRESENTATIONS OR WARRANTIES WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY REPRESENTATION OR WARRANTY WITH RESPECT TO THE DESIGN, COMPLIANCE WITH SPECIFICATIONS, ACCURACY OF DATA, QUALITY, OPERATION, THE MERCHANTABILITY OR FITNESS OF THE PRODUCTS AND SERVICES FOR A PARTICULAR PURPOSE, OR ISSUES REGARDING IP RIGHTS INFRINGEMENT, OR TITLE. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, EXEMPLARY, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, BUSINESS INTERRUPTION, LOST BUSINESS INFORMATION OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, EVEN IF WE KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION OR THEORY OF LIABILITY. OUR CUMULATIVE LIABILITY TO YOU, FROM ALL CAUSES OF ACTION AND ALL THEORIES OF LIABILITY, WILL BE LIMITED TO AND SHALL NOT EXCEED THE FEES ACTUALLY PAID BY YOU TO US FOR THE LICENSED SOFTWARE, PRODUCTS, OR SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE DATE ON WHICH THE CLAIM AROSE. THE FOREGOING LIMITATIONS SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. The parties acknowledge that the limitations set forth in this Section are integral to the fees charged for access to the Licensed Software, Products and Services and that, were We to assume any further liability other than as set forth herein, such fees would of necessity be set substantially higher.
